More New York protections to know
Beyond wage and discrimination claims, New York law gives workers several other protections that can matter in a dispute with an employer:
- Paid Family Leave. Most private employees in New York can take paid, job-protected leave to bond with a new child, care for a family member with a serious health condition, or handle certain needs related to a family member's military service.
- Sexual harassment prevention. New York requires every employer to have a written sexual harassment prevention policy and to provide yearly training. Complaints can be filed with the New York State Division of Human Rights or brought in court.
- Retaliation. The New York State Human Rights Law protects employees who complain about discrimination or take part in an investigation.
If your employer broke one of these rules, we review the facts, explain your options, negotiate with the employer and, when needed, take the claim to court. To discuss your situation, contact us.
Frequently asked questions
Do you represent employees or employers?
This practice focuses on employees: workers who were underpaid, mistreated, harassed or pushed out. Contact us to discuss your situation.
What is New York Paid Family Leave?
It is a state program that lets most private-sector employees take paid, job-protected time off to bond with a new child, care for a seriously ill family member, or handle certain military family needs. Eligibility depends on how long you have worked for your employer.
Where can I file a harassment or discrimination complaint in New York?
You can file with the New York State Division of Human Rights, bring a case in court, or in some cases file with the federal EEOC. Deadlines differ for each, so speak with a lawyer early.
